The following Terms of Use are entered into by and between You and Flicker Media ("Company", "we", or "us").

ACCEPTANCE OF TERMS These terms and conditions govern your access to and use of flickermedia.ca (the "Website"), including any content, functionality, and services offered through the Website, whether as a guest or registered client.

COPYRIGHT & CONTENT All content on the Website, including but not limited to photographs, videos, drone footage, virtual tours, text, graphics, logos, and images, is protected by copyright and other applicable laws. This content is the exclusive property of Flicker Media unless otherwise noted. You may not reproduce, distribute, modify, or create derivative works from any content without explicit written permission from Flicker Media.

SERVICES AND DELIVERABLES

All photography, videography, and drone services are weather-dependent and subject to appropriate flying conditions
Service delivery timeframes are as specified in service agreements
Final deliverables are provided in digital format via secure online transfer
Image quality may vary based on environmental conditions
Drone operations are subject to Transport Canada regulations and restrictions

PAYMENT AND CANCELLATION

Payment terms are as specified in individual service agreements
Deposits may be required to secure booking
Weather-related cancellations will be rescheduled at no additional cost
Client cancellations must be made with reasonable notice as specified in service agreements

LICENSING AND USAGE RIGHTS

Clients receive specific usage rights as outlined in their service agreement
Basic License: Single use, one platform ($199/clip)
Premium License: Multiple uses, multiple platforms ($399/clip)
Enterprise License: Unlimited usage rights ($899/clip)
Modification or alteration of delivered media is prohibited without written consent

USER COMMUNICATIONS You agree not to:

Post defamatory, abusive, or unlawful content
Violate others' intellectual property rights
Use the Website for unauthorized commercial purposes
Harvest information about other users
Upload malicious content or software

PRIVACY AND DATA PROTECTION We respect your privacy and follow PIPEDA principles in collecting and handling personal information. Our complete Privacy Policy details how we collect, use, and protect your information.

ELECTRONIC COMMUNICATIONS By using our Website or contacting us electronically, you consent to receive communications from us electronically. All electronic communications satisfy any legal requirement for written communications.

Services are provided "as is" without warranties of any kind
Weather conditions may affect service delivery
Flicker Media is not liable for indirect, incidental, or consequential damages
Maximum liability is limited to the amount paid for services

CHANGES TO TERMS We reserve the right to modify these Terms of Use at any time. Changes are effective immediately upon posting to the Website. Continued use of the Website constitutes acceptance of modified terms.

JURISDICTION This agreement shall be governed by and interpreted in accordance with the laws of Nova Scotia and applicable Canadian laws. Any disputes shall be subject to the exclusive jurisdiction of Nova Scotia courts.
